
LASTING POWER OF ATTORNEY
WHY GET A LASTING POWER OF ATTORNEY?
A Lasting Power of Attorney grants authority to people of your choosing to make decisions for you if you are unable to make a decision yourself. There are 2 types of lasting power of attorney, which cover:

Health and Welfare
Lasting Powers of Attorney are important legal documents which grant extensive powers to the people who you choose to appoint.

With regard to your finances, the power extends from making small bank withdrawals and paying bills, to selling your home, and everything in between. It is essential that you fully trust those that you choose to appoint to act in your best interest.
​
With regard to the Lasting Power of Attorney for health and welfare, attorneys have the power to make decisions about your general day to day activities, where you should live, and whether medical treatment should be received or refused. It can, if you wish, also extend to decision regarding life sustaining treatment.

Fees
​
The fees for the preparation of Lasting Powers of Attorney (LPAs) are as follows:
​
Single LPA: £325
​
2x LPAs (both finances and health for one person, or one type for 2 people): £545
​
4x LPAs (both types for 2 people): £875
​
Before a Lasting Power of Attorney can be used, it must be registered with the Court of Protection. There is a separate court fee of £82 per document, which is payable to the Court of Protection, for the forms to be registered.

Process
​
The process for the preparation of Lasting Powers of Attorneys is as follows:

We will meet by either home visit or zoom. There is no fee for the initial meeting. In this meeting we will discuss the assets that will be covered by the lasting powers of attorney, who you wish to grant the power to, what your concerns are, and which forms are most suitable to meet your needs, and how best to draft them for your assets and circumstances.

I will write to you within 5 days are our initial meeting to confirm your instructions and the applicable fees. In this letter I will request that you confirm that you wish to proceed, and that payment is made on account.

When I have received confirmation that you wish to proceed, I will send you a draft summary of the Lasting Powers of Attorney for you to review.

When this has been approved we will arrange a meeting to sign the final documents.

If it is possible for your chosen attorneys to attend this meeting, then that will save time in the finalisation of the forms. However, it is not essential.

If your attorneys have not attended this meeting, following the meeting where you have signed, I will post the forms to your attorneys for them to sign at their convenience in the presence of a witness.

Once the forms have been signed by all parties, I will submit them to the Court of Protection to be registered. The registration process usually takes around 12 weeks.

When the forms are registered, the court will return them to me. I will review the final forms and ensure there are no errors in the registration process.

Finally, I will prepare 2 certified copies of the documents, and take a scan of the completed documents. I will send the original forms and the 2 certified copies to you to store at home, and to use as necessary.

I recommend that you keep the original documents in a safe place, and use the certified copies to give to third parties who require sight of them.
